....[1]a serious mistake, caving in to political pressure and placing
the NSA surveillance program under FISA court supervision. There never
was any doubt the program was legal, but now the President has ceded
additional authority that belonged exclusively to his office. Future
Presidents will be hard pressed to regain the authority once the
precedent is set. That President would have the authority of the
Constituion on his or her side, but the political pressures would be
enormous.
This is a mistake at any time, but especially in a time of war. Its
only a matter of time before the court rejects an application that
then becomes a cause celebre' for those who say the government cannot
protect us when the actor excused by the court is involved in a
terrorist attack on our soil. The court will not be held accountable.
The President will.
Just as in the case of the Campaign Finance Reform Act, President Bush
has manifested a tone-deaf ear to the importance of precedent and
history. And the Constitution has become even more irrelevant and
exposed to additional rapacious violations.
If this country is to survive, it's people must replace their
emotional reactions to obsequious political rhetoric with a steely
logic that pierces the veil of lies that surround our present
institutions. We cannot long continue to allow these Constitutional
depredations before arriving at a place from which we can never
return.
I get a big chuckle out of the EU which cackles about our "privacy
violations" while putting cameras on every street corner and recording
voices as well. The idiots here in America who whine and wail about
privacy don't have a clue what real privacy violations are. If we
continue to destory the Constitution, however, they may soon find out.
